Warranty & Legal Information

Terms and Conditions for Product Purchase and Limited Warranty Service

WestNav-Tech (referred to as ‘We’, ‘WestNav-Tech’, and ‘WestNav-Tech.com’ henceforth) provides the following warranty terms and conditions for your consideration. As a buyer (referred to as ‘You’), you have the option to cancel your order without penalty before the product ships. Orders canceled or refused after shipment will incur shipping and handling charges, along with a $250 restocking fee. Returns are accepted within 15 days of purchase, subject to a $250 restocking fee. To qualify for a refund, products must be new, unused, and in their original packaging. Refunds are only granted with valid reasons approved by a WestNav-Tech representative within 15 days of product receipt. Store credit is provided after the initial 15-day period. Please note that you are responsible for the initial shipping fees paid, which are non-refundable.

To be eligible for a return, your item must be unused and in the same condition as when you received it. It must also be in the original packaging. If the packaging has been destroyed, missing, or damaged and there is any damage or missing parts, these will be billed accordingly. Additionally, if the unit has not been powered on and is simply taken out of the box with the components seemingly too much to undertake, a restocking fee of $250.00 will almost certainly apply.

Limited Warranty

WestNav-Tech provides a 12-month factory limited warranty against defective material and/or workmanship, unless the product has been marked as final sale or discontinued. Please note that this warranty does not cover software or third-party-supplied accessories.

A ‘defective product’ is one that:

(a) fails to turn on or off as intended,

(b) renders the vehicle dangerous or inoperable with a visible warning displayed on the dashboard instrument, or

(c) has a non-functional display due to material and/or workmanship flaws.

In the event of a defective product, we will provide repair or replacement as necessary. However, we reserve the right to refuse service in cases of:

  1. damage due to undue wear and tear, dirt, misuse, improper installation or operation, neglect, or accident,
  2. damages caused by improper packaging during return, or
  3. disassembly or repair by unauthorized persons. Please note that software and your data are not covered under warranty.

For items marked as final sale or discontinued, we guarantee freedom from defects for 14 days from the delivery date, unless otherwise specified by existing terms and conditions. In such cases, we offer only repair or replacement of the same product; refunds are not applicable under any circumstance for final sale items.

The buyer is responsible for all shipping fees associated with warranty service. We do not provide prepaid shipping labels. If the returned item does not qualify for warranty coverage, the buyer is liable for all associated costs, including but not limited to repair and/or replacement expenses, as well as any incurred customs duties and taxes resulting from the buyer’s actions.

General Terms and Conditions

A. All products offered require special knowledge or professional assistance to work as advertised, and the buyer is responsible for any costs associated with acquiring, removing, or returning the product. WestNav is not responsible for any costs incurred by you for services or products to achieve the desired function(s) from any WestNav-Tech product.

B. It is the buyer’s responsibility to check and verify if the purchased product is compatible with their vehicle.

C. A $250.00 restocking fee will be applied if you return your purchase and WestNav authorized personnel find no defects on the returned product.

D. A refund will not be issued for non-fitment with your vehicle. Please carefully read the item description and ensure it is the correct product for your car.

E. Taxes and duties are entirely the responsibility of the buyer.

F. A refund or replacement will be provided if you received a damaged item due to improper packaging. However, shipping fees are not refundable. We will cover return shipping fees if the damage is due to a fault on our end.

G. All merchandise being returned must be in the original box, unused, and include all wires and accessories (no wear and tear present). After we test the unit, if a manufacturer’s defect is found, we will issue a refund.

H. Please carefully read the electronically provided installation booklet before installation or seek professional installation assistance.

I. In case of a defective product dispute, the buyer must provide evidence in the form of pictures or video files of the defective product and demonstrate that the product’s installation was free of errors through pictures or video files. We reserve the right to refuse any claim without sufficient evidence provided by the customer.

J. Any damage done to your property while installing and operating our device is the buyer’s responsibility unless it is proven by an appropriate government agency that our product is the direct cause of the damage.

K. No replacement device can be sent until the faulty device is returned. We cover all shipping fees only if you truly received a defective product.

L. Obey laws and regulations applicable in your region while driving, and do not operate any WestNav-Tech device or let it divert your attention from the road while operating your vehicle. Only operate a WestNav-Tech device when stopped and it is safe to do so. WestNav-Tech is not responsible for any incidents that may occur while you are driving and operating the device.

Special Conditions Disclaimer

We will make every effort to address any issues you encounter, but we reserve the right to refuse any refund claims related to the declared conditions below after 15 days of receipt of the product, after which only a replacement may be offered with prior arrangement.

  1. Sound playback quality or noise issues may be present depending on the vehicle, especially if there are alternator problems or ground isolation issues. We do not guarantee that our product will be free of any noise issues, as poor installation or vehicle conditions can introduce noise or sound quality problems.

 

2 . Third-party accessories (e.g., CarPlay/Android Auto USB Dongle, Rear Camera, or any non-WestNav-Tech manufactured accessories) may not work fully or as intended. We do not guarantee the functionality of third-party accessories. In the event of accessory failure due to manufacturer defects, we will replace it once or refund the cost of the accessory.

  1. All our network-capable products are Class B radio products under FCC regulation and are susceptible to radio interference. Bluetooth/Wi-Fi function may not be fully functional if 2.4 GHz bands are congested or near a strong microwave interference source such as an airport.
  2. In some models, the SD card and SIM card slots are located on the back panel or the SD card slot may not be available. Access to existing slot(s) may be difficult.
  3. There may be some software bugs; every effort will be made to address these in future software updates.
  4. Background static noise, humming, radio, and electronic interference apart from audio playback may occur depending on the vehicle condition, installation method, and operation.
  5. 3G/4G mobile network function may be limited or non-functional depending on your mobile network carrier’s policy or configuration.
  6. The item is an aftermarket product. We do not guarantee any cosmetic aspects, such as fitment or color match to your vehicle. The product color may vary from the original trim, and it may not fit perfectly. These aspects do not constitute ‘a defective product’ as defined above.
  7. Installation is not included in the price. It is the buyer’s responsibility to find a professional installer if necessary.
  8. Installed apps may require network connectivity to be functional and may require periodic updates. Any data charges from your network or internet service provider are your responsibility.
  9. The device will draw power from your battery even if the engine stops and the ignition is turned off. The screen may not turn off immediately after leaving the vehicle and locking it. This is normal behavior. The device will automatically turn off after a prescribed period of inactivity when the car is turned off.
  10. Shipping fees paid are non-refundable in any circumstance, except in cases where there is a failure to ship from WestNav-Tech, such as with eBay Purchases (on a ‘You pay to try’ basis).
  11. All of our products are NOT ready-to-play devices. They may require special knowledge and/or professional help to achieve all advertised functions. This may involve several hours of professional help and troubleshooting that you may have to pay for additionally. WestNav-Tech provides email/telephone assistance free of charge, by appointment only. Under no circumstances will WestNav-Tech be responsible for any expenses you choose to pay to a third party.
  12. A return shipping label is not provided under any circumstances. Return labels may not pass customs inspection; therefore, WEST NAV-TECH cannot issue return labels outside of Canada. KEEP YOUR SHIPPING RECEIPT FOR ANY RETURNS. We will reimburse your cost of return if, and only if, you receive a defective product and we receive the merchandise back in acceptable condition. Unauthorized returns will be refused upon receipt by WestNav-Tech.
  13. We reserve the right to designate a proper return address. Our return instructions override any generic instructions from PayPal or your Credit Card Company. It is simple: we reimburse you when WestNav receives the product back in acceptable condition.
  14. Any failure to follow the return instructions from WestNav-Tech.com or their affiliate(s) will result in the refusal of warranty, and deduction of any incurred or additional costs from the refund due. WestNav-Tech.com is not responsible for any damage to you or your property resulting from not following the instructions provided by WestNav representatives in writing.
  15. WestNav-Tech.com reserves the right to cancel device registration if payment has not been completed or is declined after shipping its products. For example, if you file a chargeback, WestNav-Tech.com will cancel your device registration, resulting in the suspension of your ability to use the device. An ‘inactivation warning’ will appear on the screen every 5 minutes after the next scheduled software update. WestNav.com will not reinstate any device that is not properly and completely paid for.
  16. Special note related to Apple CarPlay and Android Auto for WestNav-Tech—branded Android Systems:

APPLE INC AND GOOGLE LLC PROVIDE SERVICES SUCH AS ‘CARPLAY’ AND ‘ANDROID AUTO’ WITHOUT ANY WARRANTY THAT THEY WILL FUNCTION AS EXPECTED. NO AUTO MANUFACTURER WILL ALLOW A BREACH OF AN AUTOMOBILE SALES CONTRACT BECAUSE CARPLAY OR ANDROID AUTO IS NOT FUNCTIONING AS EXPECTED. THUS, WEST NAV CANNOT BE HELD RESPONSIBLE FOR ANY MALFUNCTIONS OF THE CARPLAY OR ANDROID AUTO SERVICE, AS THE NATURE OF THE SERVICE IS PROVIDED WITHOUT ANY WARRANTY.

ALSO, CARPLAY AND ANDROID AUTO RELY HEAVILY ON THE HOST MOBILE PHONE, AND INSTABILITIES ARE COMMON IN THE AUTOMOTIVE INFOTAINMENT SYSTEM INDUSTRY. THEREFORE, WESTNAV.COM IS FREE OF ANY LIABILITY RELATED TO ISSUES WITH CARPLAY AND/OR ANDROID AUTO.

By purchasing from WestNav-Tech.com, you agree to its terms and conditions. IT IS SOLELY THE BUYER’S DECISION TO PURCHASE ANY PRODUCT FROM WestNav.COM, AND WestNav.COM HAS CLEARLY NOTED THAT.

APPLE CARPLAY AND GOOGLE ANDROID AUTO SERVICE IS NOT A GUARANTEED FEATURE OF WESTNAV-TECH’S ANDROID PRODUCT. By purchasing from WestNav-Tech.com, you acknowledge that you have been informed about these special terms and conditions and have agreed to them.

The legal definition of WestNav-Tech.com’s Android system product is an Android-compatible car infotainment system screen replacement, not a CarPlay or Android Auto receiver.

For the WEST NAV ANDROID SYSTEM PRODUCT, THE FAILURE OF RUNNING APPLE CARPLAY OR ANDROID AUTO SERVICE IS NOT A VALID REASON FOR RETURN, REFUND, OR WARRANTY CLAIM.

The Apple CarPlay/Google Android Auto feature is not a service or product manufactured and designed by WestNav-Tech.com and its factory. CarPlay and Android Auto, available on any of the WestNav.com Android systems, are offered without any warranty.

Unless approved by a representative at WestNav-Tech.com that the cause of CarPlay and Android Auto failure is due to a defective product as defined above, you cannot claim any warranty service, refund, or breach of contract solely because CarPlay and Android Auto are not working as expected.

For example, you are not allowed to file any claim against WestNav-Tech.com when the WestNav-Tech.com Android System is working normally and performing expected functions such as GPS reception, running Android navigation apps, playing music files over Bluetooth or from internal or external memory, playing movie files in common supported formats, and running common Android apps that do not require special hardware or service, but only fail to run Apple CarPlay or Google Android Auto properly.

The buyer’s purpose of the purchase, whether expressed explicitly or implicitly, is NOT a valid reason for any return, refund, or warranty service. For example, “I purchased WestNav-Tech.com Android system solely for the purpose of running Apple CarPlay or Android Auto, and CarPlay or Android Auto is not working as I expected” is not an allowed reason for the return, refund, or warranty service for the WestNav.com Android System.

for any changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

For example, Acceptable reasons are like the following: (However, not limited to these):

Android system arrived physically broken or Android system hardware is not turning ON properly or displaying properly. (e.g. Screen is randomly turning on and off and/or the screen shows electrical noise patterns in general Android mode.)

In the case of CarPlay or Android Auto service failure due to the failure of WestNav.com supplied third party products and service such as zBox, AutoPlay USB dongles, ‘Head unit Reloaded’, ‘Z-link’ software, WestNav.com will refund only the cost of the third party product and service.

UNLESS THE LAWS OF QUEBEC PROHIBITS, THE TERMS AND CONDITIONS IN WESTNAV.COM PRESIDES ANY OTHER REGULATION OR LAW OF BUYER’S JURISDICTION OF HIS/HER PRIMARY RESIDENCE.

In no case shall West Nav, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Our liability will be limited to the extent permitted by law in those states or jurisdictions because some states or jurisdictions forbid the exclusion or limitation of liability for incidental or consequential damages.

SECTION 14: INDEMNIFICATION

You agree to indemnify, defend, and hold harmless West Nav and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15: SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16: TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our services or when you cease using our site. If, in our sole judgment, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we may also terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination, and/or accordingly, we may deny you access to our Services (or any part thereof).

Part 17: WHOLE AGREEMENT

No right or provision of these Terms of Service shall be deemed waived by us in the event that we are unable to exercise or enforce such a right or provision. This agreement governs your use of the service and supersedes any prior or contemporaneous agreements
